Occupational Health and Safety Act (ArbSchG)
The Occupational Health and Safety Act (ArbSchG) is the basic law on occupational health and safety in Germany. It lays down the general obligations of employers and employees to ensure safe and healthy working conditions.
§5 ArbSchG - Risk assessment
A central regulation is § 5 ArbSchG (assessment of working conditions). According to this, the employer is obliged to carry out a risk assessment to determine and evaluate the hazards associated with the employees' work. Both physical and mental stress must be taken into account. Based on this assessment, the necessary protective measures must be taken and their effectiveness checked.

The Occupational Health and Safety Act is substantiated by various health and safety regulations that make the legal framework tangible in practice.
These include the Workplace Ordinance (ArbStättV), which sets out clear requirements for the design of workplaces and workspaces. The Ordinance on Industrial Safety and Health (BetrSichV) ensures that work equipment and technical systems are safe to use. In addition, the Load Handling Ordinance (LasthandhabV) regulates the safe handling of physically moving loads and is intended to prevent back and joint strain on employees in particular.
